Why we decided not to go to a Q&A with the EHRC about their current consultation

Last week, we were invited to attend a Q&A with the EHRC about the consultation that they are currently running on updating their Code of Practice (new tab) following the Supreme Court judgment last month that “sex” in the Equality Act 2010 means “biological sex”.

We thought carefully about whether to attend – particularly as we think it’s really important to speak up for the importance of a society, services and a legal framework that allow trans people to live good lives.

We decided not to go. The invitation made it clear that we wouldn’t be listened to, and we have been really concerned about how the EHRC has responded to the judgment so far. We couldn’t see a way that taking part would lead to any kind of concrete, positive outcome for trans people.
